Defending Sweepstakes Gaming

Some big names are defending the model. Edward King, a venture capitalist and co-founder of Acies Investments, believes sweepstakes are just the next step in the evolution of online gaming. He pointed out that when people use the term “grey market,” it doesn’t always mean something shady. Instead, it’s about industries evolving faster than regulations can keep up.

For King, sweepstakes are legal, even if the laws aren’t quite up to speed. He compared the situation to other gaming sectors that have faced similar regulatory challenges and eventually became regulated as the industry matured. He sees sweepstakes as part of that natural growth process.

The Critic’s View

But not everyone is convinced. John Lessnau, from the Michigan Gaming Control Board (MGCB), has been a vocal critic. He argues that, no matter what you call it, sweepstakes gaming is just another form of gambling. Lessnau made an interesting comparison to McDonald’s Monopoly promotion. He pointed out that while Monopoly helps sell more burgers, it’s not a form of gambling. Sweepstakes, however, are available 24/7, and that constant opportunity to win makes it look more like gambling in his eyes.

“Gambling is profitable, and that’s why there’s a big push for sweepstakes,” Lessnau said. “When they’re run all the time, you’re talking about an expansion of gambling.”

Where Do You Draw the Line?

Some experts, like Matt Kaufman from Eilers & Krejcik Gaming, think the line between sweepstakes and social casino games is a bit blurry. He pointed out that many social casino platforms already use sweepstakes as a way to promote their games. The issue, according to Kaufman, is that there’s no clear distinction between a legal sweepstakes and a gambling product.

“There’s this idea that you can occasionally run a sweepstakes to sell Gold Coins, but when you do it more frequently, it crosses the line,” Kaufman explained. “It just feels like an arbitrary distinction.”

For Kaufman, the problem is the inconsistency in how sweepstakes gaming is treated. He believes there should be a more clear-cut regulatory framework to handle this growing space.

Traditional Operators Are Watching Closely

Traditional casino operators aren’t exactly thrilled about the rise of sweepstakes gaming either. Derek Stevens, who owns the Circa Sports casino, expressed concerns during his keynote at G2E. He believes sweepstakes operators have found a loophole and are exploiting it for profit. But Stevens isn’t convinced this model is sustainable in the long run.

“They found the loophole, but it’s not realistic that this is sustainable,” Stevens said. “There’s no governing bodies here.”

Stevens emphasized that there’s a need for more regulation and oversight before the sweepstakes space becomes too big to manage. He worries that millions of dollars are being wagered without the proper checks and balances.

Will Sweepstakes Gaming Be Regulated?

Despite the criticism, there’s still a belief that sweepstakes gaming could eventually find its place in the regulated market. Matt Davey of Tekkorp Capital sees this as a possibility, similar to how daily fantasy sports (DFS) evolved. He believes the sweepstakes model could eventually be fully regulated, just like other gaming sectors have been.

“There’s product-market fit, but does this fit within a regulated environment?” Davey asked. “That’s the question we have to answer.”

It’s clear that this debate isn’t going away anytime soon. As the sweepstakes gaming market continues to grow, regulators and operators will need to figure out how to handle it. Will it be absorbed into the regulated gaming world, or will it remain in the grey area where it currently resides?

The rise of sweepstakes gaming has everyone talking. On one hand, it’s an innovative new gaming model that’s attracting players and investors. On the other hand, it’s a source of concern for those who feel it skirts the lines of what’s considered legal gambling.
